Baker pleaded guilty to fraud by false representation at Sunderland Magistrates Court and, according to prosecutor Lee Poppett, claimed the rat had bitten his finger before demanding a refund which was granted. Acorn Pest Control attended the scene and thought the rodent was in fact a pet. He was eating alone and appeared to fiddle with his pocket when he went to pay the bill. Waiters apologised and gave Baker a refund, however, he has now been struck by a 12-month community order with supervision along with paying a £60 victim surcharge and £7.25 in compensation to Kevin Smith, the owner. Speaking after the case, Mr Smith was fearful of the impact it would have on his business: "He could have destroyed the reputation I have built up over seven years. I was devastated. I thought 'that's it my business is gone'. I didn't sleep that night. I find it unbelievable that someone could be willing to go to those lengths for a free meal." Baker told police he had bought the rat from a pet shop as a gift for his daughter.
