Many accountants who were unable to attend Shout99’s ‘Opportunities from change in the
contracting market’ seminars on IR35 have requested that we make more information available
about the presentations and Question & Answer sessions.

IR35 is a tax affecting service companies and consultants especially in IT and Engineering.
It threatens to treat all consultants as ‘disguised employees’ over National Insurance
Contribution issues. Shout99 ran the seminars to help clarify the implications of IR35 for
contractors, accountants, clients and agents with industry representatives including the
Professional Contractors Group- a professional body of 14,000 contractors which campaigns
against the legislation and other relevant issues.

The Shout99 transcripts are an invaluable record of the information given out on the day and
are indispensable as a reference manual for any accountant who has contractor clients needing
informed and accurate advice on their clients’ contract issues. The information presented,
as well as the answers to audience questions by the expert panel shone new light on many
people’s understanding of the legislation and how they could not only avoid falling foul of
IR35, but actually use it to their advantage.

The transcript pack comprises the three presentations given by: Kevin Miller- a Chartered
Accountant and Director of the PCG, Andy White- Shout99’s Editor and founder of the PCG and
Tony Askham- Head of Litigation at Bond Pearce solicitors who led the judicial review of IR35
against the Inland Revenue in the High Court earlier this year.

The Q&A session, featuring a panel of representatives from the PCG, as well as expert advice
from two ex- Revenue inspectors working for tax consultants Accountax and Qdos, has also been
fully transcribed for the pack and features information on a wide range of IR35-specific
subjects, including:

1. Background to the regulations;

2. Completing P35 and other statutory documents;

3. Contract issues (and Mutuality of Obligation - MOO), Substitution and Back-to-Back;

4. Being in business on your own account - and how to use the ‘uncertainty’ to your

5. Recent relevant case law and legal decisions/ getting professional advice;

6. The relevance - or not - of contract length and multiple income streams;

7. How to minimise the risk of Penalties.

The questions asked on the day will be the same questions 1000s of contractors will be asking
their accountants as long as the legislation exists.

Accountants with contractor clients present on the day also found the practical advice from
Kevin Miller and the ex-IR inspectors a powerful insight into the un-charted waters of
‘dealing with the Revenue'. Their guidance, coupled with Andy White’s presentation on how
personal service companies should run a business to demonstrate they are in business
satisfactorily - clearly identified how to reduce the risks of falling foul of IR35 and
reduce the risk of penalties from the IR as a result of these decisions.

The pack is available now from for £30.00.

Notes for Editors:

Shout99 provides news and information for all independent contractors and related parties
(clients, accountants, others).

1/. Updated regularly with the latest contractor focused news and views, you'll find a wealth
of information on the site. We are best known for our comprehensive coverage of IR35, but the
interactive news site section allows you, the reader, to post comments and questions on a
range of issues.

2/. Independent contractors are a growing band working at the cutting edge of the flexible
economy. Contractors are prepared to invest in and market their own knowledge and expertise
in a commercial environment, competing with larger organisations in a climate that is
becoming increasingly more hostile for the small knowledge-based entrepreneur.
