Freelancers Outside IR35 (FO35) is a new system launched by Shout99 (www.shout99.com) which gives freelancers the tools to demonstrate they are outside IR35 without having to run the risk of penalties.

Many of the practical difficulties relating to IR35 have stemmed from the fact that freelancers were expected to operate in unknown and uncharted territory when making decisions about their status - but they had to risk living with the prospect that they could face heavy fines if the Revenue disagreed with their assessment of whether they were a 'genuine business' or a 'disguised employee'. It was the cost of that uncertainty which has proved the biggest obstacle for many freelancers.

Freelancers Outside IR35 (FO35) offers freelancers a complete annual package to enable them to make an informed decision to be outside IR35; to demonstrate how that decision was reached; to have top professional support and representation if the Revenue or Customs should challenge - and to be insured against penalties even if the Revenue does successfully challenge their decision.

FO35 is a unique business operating system which provides a manual for status determination and detailed guidance; models contracts which are outside IR35; insurance against investigation by the Revenue; insurance against penalties; and support and representation from Qdos, one of the country's leading IR35 consultancies.

FO35 has been devised by Shout99, the UK's largest network of freelancers, and Qdos, a leading firm of tax consultancy specialists, who has saved freelancers it has represented more than £1.5 million relating to IR35 enquiries to date. Its team of consultants are mainly former Inland Revenue and Customs & Excise experts.

Andy White, managing director of Shout99, who has been a leading campaigner against IR35 since March 1999, said: "The uncertainty surrounding IR35 has meant that many freelancers would not take the decision to say they were operating outside IR35 for fear of incurring penalties should the Revenue say they 'got it wrong'. The price of the uncertainty was too high.

"FO35 provides the tools, information and support that each freelancer needs to confidently decide they are going to defeat IR35 themselves and provides the professional representation to support and defend that decision.

"It also removes the cost of uncertainty and allows freelancers to make the decision about their status based on relevant information rather than fear, uncertainty and doubt."

Freelancers Outside IR35 is a complete business operating system which comprises:

a manual which shows how to demonstrate you are outside IR35;

practical help on how to record and maintain this information;

guidance on how to confidently determine your own IR35 status including simple decision trees;

regular upgrades to the manual as circumstances change;

model contracts which are outside IR35;

12 months tax enquiry insurance which provides professional assistance in the event of a tax investigation by the Revenue or a VAT investigation by Customs and Excise;

professional representation and support (from Qdos) if your case goes to the Special or General Commissioners;

12 months penalty insurance - so even if you are later found to be inside IR35, you will be guaranteed there will be no penalties;

a tax helpline operated by Qdos;

a dedicated area of the Shout99.com website to keep you up-to-date with developments;

sample letters from the Inland Revenue; explanations of what they mean - and guidance on what to do if you get one.

Notes for Editors:

1. Shout99.com is the largest network of independent freelancers in the UK.

2. The website provides news and information for independent freelancers and related parties (clients, recruitment agencies, accountants and others).

3. Its name comes from the code word 'ninety-nine' used by the British Lions rugby team while on tour in South Africa in 1974. If one of the team was under threat, a shout of "99" would bring instant support from all team-mates. The undefeated British Lions of that era have become acknowledged as the epitome of teamwork and camaraderie. The Internet brings the ability to shout "99" to thousands of like-minded small businesses.
