RAIDAR (Raid – Asset Recovery), the UK’s first fixed-price anti-counterfeiting service has been launched by digital, IP and interactive media law firm Briffa

RAIDAR which has been created in partnership with an international network of alliances offers new approach in the fight against piracy and counterfeiting. This ensures that counterfeit operations are quickly identified, investigated and closed down, and critically, done so, within an agreed budget.

“Intellectual Property rights are a crucial part of any business so it is essential that they are protected. Whilst businesses are painfully aware of the damage that piracy does, we found that most are concerned that the costs of tackling the problem might outweigh the benefits - RAIDAR will prove that this does not need to be the case," explains Alex Chapman the Partner in charge of interactive media and computer games at Briffa.

The core benefit offered by RAIDAR is its focus on providing an efficient, fixed fee solution to help stem the growth of counterfeit products that affects every industry from games and software developers, publishers, distributors, retailers and rights owners. In the UK alone, more than £26 million is lost to counterfeiters every day.

RAIDAR is based on simple principles: a strategy which makes the most effective use of the rights available to, or already owned by, businesses and a co-ordinated national and international capability. The services that make up RAIDAR operate through three phases of preparation, investigation and enforcement.

The first of these comes through a full understanding of the business and laws affecting rights owners. “Much has been made of the way copyright piracy is growing – especially online. Offline it is just as much of a problem but rather than focus on copyright, by using trade mark rights (which will also be infringed by piracy) action can be taken in a fraction of the time and a fraction of the cost”, says Naazneen Schmittzehe, the solicitor at Briffa who set up RAIDAR and whose extensive experience in anti-counterfeiting spans both Europe and Asia.

Schmittzehe added, “We also recognise that for an anti-counterfeiting strategy to be effective, expert local knowledge is essential. This is why we have over the years forged close partnerships with an internationally recognised network of local investigators, enforcement agents, customs and trading standards officials and other administrative authorities based around the world in counterfeit hot spots such as China.
