Level of innovation across the field impresses judges
At an award ceremony for 240 figures from the Alternative Dispute Resolution (ADR) and legal community held at The Chancery Renaissance in London on 12 November 2008, the CEDR awards for excellence were announced. The panel of awards judges were The Master of The Rolls Sir Anthony Clarke, Marina Paul of HBOS, Ruth Grant of Lovells, Michel Kallipetis QC, Gerry Lagerberg of PricewaterhouseCoopers, Ian Luke of Skanska and Jane Player of Bird & Bird.
Eversheds won the Professions award for the roll out of their RAPID Resolution tool across 40 offices in 25 countries. The process aims to achieve the best possible practical solutions for business rather than legal successes and has attracted impressive plaudits from multinational clients as diverse as Boeing, Tyco and Royal Sun Alliance.
Her Majesty's Court Service won recognition in the Sector category for the growth and success of the Small Claims Mediation Service in the past two years. The service has quickly become the largest single mediation service in the UK, with 5097 mediations conducted in the year to July 2008. A recent survey has shown that 98% of users were satisfied or very satisfied with the professionalism and helpfulness of the mediators; with 94% saying that they would use the service again.
The Business category was won by E.On Group, based in Germany. In just two years, their business mediation project has developed all of the key characteristics of model corporate behaviour, including embedded ADR clauses and conflict management policies, staff awareness raising and training of internal mediators. This leadership initiative is now being used to engage with other German based organisations, including Siemens, Deutsche Bank, Deutsche Telekom and Audi.
Tokiso Dispute Services, which won the International category, has risen to the often-difficult challenges of providing ADR services to a modern South Africa. A pioneer in the commercial field, building on a long tradition in labour disputes, Tokiso have worked to establish best practice and created a sophisticated professional development structure, whilst promoting stimulating debate on ADR in the media of South Africa.
The winner in the Publications and Article category was Mediation of Construction Disputes by David Richbell. The judges agreed that David delivered essential reading for those involved in disputes in the construction industry with valuable wisdom for mediators and clients from other fields too.
Chosen from all the awards finalists, Michael McIlwrath of General Electric Oil and Gas won the Innovations award, for the International Dispute Negotiation pod casts available on the website of the International Institute for Conflict Prevention and Resolution in New York. By finding interesting speakers and challenging topics each week, Michael is providing thought-provoking content on important issues for the ADR community.
For the first time in the history of the awards there was also a judges' commendation in the innovation category. This went to Fiona O'Donnell of the Dundee University for her creativity and dedication to making ADR a key feature of University life. The "Dundee Model" is now being taken up by numerous Higher and Further Education establishments in Scotland.
The Tony Curtis award for achievement by a young person in the field of ADR received a number of admirable entries, however, none that had gone above and beyond the call of individuals' day jobs. Instead of making an award CEDR announced that for the next two years it would undertake a campaign to inspire young people to become involved in ADR. This will include developing a young person's network and holding special events.
Dr Karl Mackie, Chief Executive of CEDR said, "It is encouraging to see that in their 14-year history innovation remains a core component of these awards at such an important time. With the global economy still reverberating with the financial crisis, corporate and public funds are likely to be tighter and fuses in disputes are likely to burn quicker and be more combustible. The choice facing us all is how we now handle these disputes as there is a real opportunity for everyone to pursue innovative and intelligent options to combat conflict in difficult and expensive times."
